PubblicazioneIl diritto dei ghiacciai tra diritto interno e risarcimento del danno(EUT Edizioni Università di Trieste, 2026)The paper intends to get on some issues of glacier law, from the legal perspective of damages compensation, starting from the public nature of glaciers. The elements of damage to the glacier can be identified as damage “to” the glacier and damage “for” the glacier, in light of some recent tragic events that have led even jurists to consider a source of damage related to the issue of glacier melting caused by climate change. For instance, the legal issues underlying the Marmolada tragedy and the Blatten catastrophe will be addressed, with the aim of outlining some significant guidelines for glacier law, in relation to the damages compensation in civil Italian law. In this vein, some significant legal decisions issued following the most significant environmental damage trials dating back to the second half of the twentieth century. will align the outcomes of these proceedings and the underlying legal issues with a possible “law and preservation of glaciers and alpine people”, also in constitutional and administrative jurisprudence. Finally, the paper address a topic partly connected to the rights of glaciers, namely the preservation of mountain areas, alpine populations and animals, through an efficient healthcare network of home and local care.

PubblicazioneLa protezione del “tesoro bianco” cinese: riflessioni sul diritto in materia di ghiacciai a partire dal Regolamento di protezione dei ghiacciai della Regione autonoma del Tibet(EUT Edizioni Università di Trieste, 2026)2025 was proclaimed by the UN as the International Year of Glaciers’ Preservation. This initiative has been particularly relevant for China, where some of the world’s tallest mountain ranges are located. As it is shown in the third Chinese Glacier Inventory, published in 2025 and based on data collected in 2020, the surface covered with ice is considerably smaller compared to the past, and thousands of glaciers have already disappeared. From a legal point of view, while the Chinese Constitution does not mention glaciers directly, it establishes the importance of environmental protection. The Qinghai-Tibet Plateau Ecological Protection Law of 2023 also deals with the melting ice issue, and the Regulation on Glacier Protection of the Tibet Autonomous Region is entirely dedicated to the protection of these vulnerable ecosystems. This article analyzes the characteristics of this regulation and presents some considerations on its role within the Chinese environmental law system.

PubblicazioneDiritto e politiche di adattamento per i territori glaciali e post-glaciali(EUT Edizioni Università di Trieste, 2026)Glaciers have long received limited attention in international and domestic law, despite their essential ecological functions. This paper explores the legal challenges posed by rapid glacier retreat due to climate change, moving from historical questions of ownership and classification toward a new legal paradigm: post-glacial law. As the cryosphere declines dramatically, legal systems must shift focus from mitigation alone to urgent, large-scale climate adaptation. However, the adaptation paradigm is not ideologically neutral; it risks being co-opted by neoliberal narratives that emphasize flexibility and market-based solutions while avoiding structural change. This study argues for a positive, ecological, and solidarity-based adaptation, one that actively transforms societies, protects vulnerable communities, and ensures just governance of deglaciated territories
