Drafting Court Judgment in Italy: History, Complexity and Simplification

Abstract
This article examines a key problematic aspect contributing to the obscurity of Italian court judgments: verb tense distribution. The qualitative approach implemented to identify text components and relate them to verb tense distribution is complemented by quantitative analyses using statistical software. Lexicometric surveys are conducted to ascertain whether differences emerge between judgments produced in Italy and Switzerland and at the Court of Justice of the European Union (CJEU). These enable us to provide insights and suggestions for more effective drafting techniques.
