Il principio di fiducia reciproca è stato definito dalla Corte come la raison d'être dellUnione per la prima volta nellambito dello Spazio di libertà sicurezza e giustizia Nonostante la sua crescente importanza nel diritto dellUnione, la concettualizzazione del principio è ancora in itinere. Sulla falsariga della definizione fornita dalla Corte nel parere n.2/13, la tesi si propone di indagare i tratti fondamentali del principio. Saranno poi analizzati due settori del diritto dellUnione in cui la tenuta del principio è stata messa alla prova da gravi violazioni dei diritti fondamentali, al fine di stabilire se una conciliazione tra fiducia reciproca e tutela effettiva dei diritti fondamentali è possibile.
The principle of mutual trust has been defined by the Court as the raison d'être of the EU legal order for the first time in the context of the Area of Freedom Security and Justice. Despite of its increasing value in EU Law, a conceptualisation of the principle is still on the way. Following the model provided by The CJUE in Opinion 2/13, the analysis first focuses on the general features of the principles. Hence it tests the effects of mutual trust in two different policies of the EU in order to assess if a settlement between the principle and the effective protection of fundamental rights is feasible.
