La 219/2017 non è solo una legge sul fine vita, né un testo che si limita a confermare quanto già acquisito in virtù dell’attività di dottrina e giurisprudenza. È una legge che consente di fare cose buone, incidendo profondamente sulle relazioni in ambito sanitario. Occorre, a tal fine, uno sforzo per riconoscere la ricchezza di significato dei termini nuovi, presenti nella legge, così come il nuovo e diverso senso che anche i termini già noti assumono all’interno del nuovo contesto; dando altresì valore a quanto, volutamente, è invece assente dal lessico della nuova normativa. Una legge oggetto di molte e profonde analisi eppure generalmente poco conosciuta e ancora meno applicata. È tempo che tutti si impegnino, ciascuno nel proprio ruolo, in uno sforzo operativo volto a rimuovere gli ostacoli che impediscono la realizzazione al molto di buono che v’è in questa legge.
The l. 219/2017 is not just an Act regarding “end of life” issues, nor a text that merely confirms rules already known, by virtue of scholars’ and judges’ activity. It is an Act that allows to do good things, deeply affecting relationships in all the health sector. To this end, an effort is needed to recognize the richness of meaning of the new terms, adopted in this law, as well as the new and different meaning that “old” words acquire in the new context; giving also value to what is deliberately absent from the lexicon of the new legislation. An Act deeply studied and analysed, yet generally little known and even less applied. It is time for everyone to commit, each in their own role, in an operational effort aimed at removing the obstacles that prevent the realization of all the good that is in this Act.
