L'adesione dell'Unione europea alla Convenzione europea per la salvaguardia dei diritti dell'uomo e delle libertà fondamentali

Although the difficult negotiation process for the accession of the EU to the ECHR has just ended, the path towards accession seems to be still fraught with obstacles. Starting from the analysis of the protection of fundamental rights within the two systems (the ECHR and EU), the study of the most complicated issues that have caused the prolongation of the negotiations outlines the deficiencies and limitations of a system that, instead, seems to be tending towards forms of closer integration.

Sebbene il difficile processo di negoziazione dell'aesione dell'UE alla CEDU sia appena terminato, la via verso l'adesione pare ancora irta di ostacoli. Partendo dall'analisi delle modalità di tutela dei diritti fondamentali all'interno dei due sistemi (CEDU e UE), lo studio delle questioni più complicate che hanno causato il prolungarsi dei negoziati delinea le carenze e le limitazioni di un sistema che, invece, sembrerebbe tendere verso un'integrazione sempre più stretta.
