In this paper I discuss the philosophical and case-law evidential possibility of an inversion of subsidiarity as a customary law principle. Starting from Greblo’s remarks on cosmopolitanism and human rights I suggest what could be like to discuss the contours of a new constitutional order of law international sovereignty wherein a centralized authority – an imagined Leviathan – would absent.
