Covid-19 e ripristino dei controlli alle frontiere interne

Abstract
The Covid-19 emergency has prompted many Schengen Countries to reintroduce internal border controls in order to prevent the spread of the infection. In absence of coordination, this measures seriously affected the free movement of persons and goods, hindering the delivery of products. This paper illustrates the procedures that Schengen Countries must respect when they intend to restore controls at internal borders and examines the practice followed by them before and after the outbreak of the Covid-19 pandemic. The measures recommended by the European Commission to preserve the unity of the common market have been carefully examined. The work highlights the opportunity to update the Schengen Borders Code, introducing a new procedure for health emergencies that seriously jeopardize the internal security of Member States. In this new procedure, the coordination role of the Commission and the scientific advice of the ECDC and other EU bodies should be expressly recognized.
