This paper, originally a presentation of Luigi Ferrajoli’s La logica del diritto. Dieci aporie nell’opera di Hans Kelsen (2016), compares the jurisprudences of the two authors, by problematizing their disagreements on the relationship between existence and validity of norms. Although both aim to formulate a general jurisprudence, their theories of law are on very different subjects. Reine Recthslehre concerns especially the law of legislative State, Ferrajoli’s garantism, instead, the law of Constitutional State.
