La nozione di “guerra giusta” in Tommaso d’Aquino: percorsi per una rilettura

Il contributo propone una rilettura della dottrina tommasiana della guerra giusta muovendo dalla tesi che essa non costituisca un'eccezione alla legge naturale, bensì una sua applicazione in circostanze estreme. Ricondotti i tre requisiti della quaestio 40 della Secunda Secundae – auctoritas principis, iusta causa, recta intentio – al primo precetto enunciato nella quaestio 94, articolo 2, della Prima Secundae, se ne mostra il funzionamento congiunto e reciprocamente limitativo, con particolare attenzione alla funzione correttiva che la recta intentio esercita sugli altri due criteri. La tenuta dell'impianto è verificata su terreni contigui – l'uccisione in legittima difesa, gli stratagemmi bellici, l'acquisizione dei beni del nemico – dai quali affiora una struttura logica costante, prossima a quel principio del doppio effetto che Tommaso non enuncia in rapporto alla guerra, ma che la sua sistematica potrebbe rendere disponibile. Su questa base possono emergere i punti di cedimento del paradigma: l'ampiezza della iusta causa, il carattere interno e difficilmente verificabile della recta intentio, l'assenza di una distinzione fra guerra offensiva e difensiva, che nell'orizzonte del XIII secolo lascia spazio alla giustificazione delle crociate. Sono questi i punti su cui interviene la ricezione, da Gaetano a Vitoria fino a Walzer e alla supreme emergency, e che rendono la dottrina, strutturalmente, tanto uno strumento di limitazione quanto un linguaggio di legittimazione del ricorso alle armi. <br/>This contribution proposes a reinterpretation of Thomas Aquinas’s doctrine of just war, based on the argument that it does not constitute an exception to natural law, but rather an application of it in extreme circumstances. Having traced the three requirements of quaestio 40 of the Secunda Secundae – auctoritas principis, iusta causa, recta intentio – back to the first precept set out in quaestio 94, article 2, of the Prima Secundae, the paper aims to demonstrate how they function jointly and mutually restrict one another, with particular attention to the corrective function that recta intentio exerts on the other two criteria. The soundness of the framework is tested across related areas – killing in self-defence, stratagems of war, and the acquisition of the enemy’s property – from which a consistent logical structure emerges, closely resembling that principle of double effect which Thomas does not explicitly state in relation to war, but which his systematic framework potentially makes available. On this basis, the weaknesses of the paradigm become apparent: the breadth of the iusta causa, the internal and difficult-to-verify nature of the recta intentio, and the absence of a distinction between offensive and defensive war, which, in the context of the 13th century, leaves room for the justification of the Crusades. It is on these points that the reception of the doctrine intervenes – from Gaetano to Vitoria, right through to Walzer and the «supreme emergency» – and it is these that make the doctrine, structurally speaking, as much an instrument of limitation as a language for legitimising the use of arms.
