Problematiche emergenti in tema di concessioni demaniali marittime a scopo turistico-ricreativo alla luce dei più recenti orientamenti della Corte costituzionale

The sentence of the Constitutional Court here analyzed reaffirms its uniform orientation regarding the extension and renewal of concessions to bathing establishments in the procedure in which it declares the unconstitutionality of some provisions of regional law to the extent that they violated the exclusive legislative competence of the State related to protection of competition, in the event that the regulation ends up influencing the modalities of choice of the contractor, effectively restricting the free execution of entrepreneurial initiatives. We must conclude that the way for the definitive reorganization of this sector can only pass through a new state, comprehensive regulation, oriented according to European directives, which intervenes to remedy an emergency regulatory framework that is no longer functional to the new dynamics of this significant sector of the Italian economy.
