This essay discusses the current technical-legal debate on the topics of protection of cultural property in European Union legislation and protection of cultural property and archaeological heritage in the Italian Code of cultural goods (legislation and recent case-law), with particular attention to the judgements of the Court of Justice of the European Community and the judgements of the Italian Constitutional Court and of other Italian high courts
