Abstract
Il saggio recupera il tema dello stato come “meccanismo
di assicurazione”, che potrebbe oggi essere preferibilmente
riconosciuto nella diffusa richiesta di certezza
del diritto e ancor più nel principio di affidamento. Per
superare la crisi l’Autore propone di recuperare il paradigma
della “prudentia iuris” così come potrebbe essere
inverato nella quotidiana attività dei giudici. The essay retraces the theme of the state as an “insurance
mechanism”, highlighting how today this
system can be recognized in the common request
for legal certainty and even more in the principle of
entrusting (affidability). To overcome this crisis the
Author proposes to recover the paradigm of “prudentia
iuris” through the daily activity of the judges.
