L'oggettivo della tesi è quello di stabilire i limiti del potere discrezionale che la P.A. dispone in materia di appalto pubblico, che deve essere esercitato senza violare il principio di uguaglianza, e alla luce di criteri non discriminatori, di logica, di ragionevolezza e proporzionalità, senza rappresentare una restrizione indebita al diritto delle aziende che operano nel mercato. Lo studio è condotto alla luce delle normative europee, in particolare quelle italiane e francesi, e brasiliane, al fine di verificare, attraverso questo studio comparativo, la fattibilità giuridica e l'efficacia delle soluzioni proposte per il miglioramento della legislazione in materia.
The objective of this research is to establish the limits of discretion that the Public Administration has to individualize the object, establishing the requirements for participation in bids and the exclusion of cases of the event, which must be exercised without violating the principle of equality, and in the light of non-discriminatory criteria, logic, reasonableness and proportionality, without presenting an undue restriction on the rights of companies in the market.
Thus, the objective of this research is to find the line between the rights of the Public Administration to maintain the requirements of technical, organizational, economic and financial capacity, as well as the grounds for exclusion of the event, in contrast to the rights of a company of not being prevented to participate in the bidding because of abominable criteria in offense to the principles of equality and free competition.
