Abstract
L’articolo è dedicato allo studio della prima traduzione completa in russo dell’opera di Cesare Beccaria «Dei delitti e delle pene», realizzata dal principe M.M. Ščerbatov nella seconda metà del XVIII secolo. Sulla base dell’analisi delle soluzioni traduttive adottate viene tracciato un quadro della terminologia giuridica impiegata, che riflette bene le caratteristiche principali del lessico giuridico russo del periodo indagato, caratterizzato da variabilità lessicale, orientamento verso le risorse lessicali propriamente russe e più genericamente slave, parallelo rifiuto dei prestiti, ampio uso di parole composte e locuzioni spesso calcate su modelli stranieri.
Статья посвящена исследованию первого полного перевода на русский язык трактата ита-льянского просветителя Ч. Беккариа, выполненного князем М.М. Щербатовым в последней трети XVIII в. При помощи анализа переводческих решений описывается использованная в переводе лексика, в которой хорошо отражаются основные черты лексикона теории русского права последней трети XVIII в. — лексическая вари-антность, ориентация на фонд исконной юридической терминологии и параллельный отказ от заимствований, широкое употребление композитов и составных наименований, нередко калькирующих иноязычные
прототипы.
This paper is devoted to the first Russian translation of Cesare Beccaria’s treatise “On Crimes and Punishments”, made by Prince Mikhail Shcherbatov in the last third of the 18th Century. Special attention is focused on use of legal terms, that shows the main features of the legal terminology in the last third of the 18th Century, i.e. lexical variability, preference for Russian and Slavic legal terminology and rare use of lexical borrowing, extensive use of compounds and loan translations.
