Negli ultimi anni, una parte della giurisprudenza ha configurato un’inedita forma di preclusione in materia cautelare, tale da produrre i suoi effetti nel giudizio principale di merito. La pronuncia offre l’occasione per analizzare il contrasto giurisprudenziale sul tema e interrogarsi sulle ragioni di questo cambiamento. L’intento è, inoltre, quello di delineare i caratteri della nuova fattispecie preclusiva e, in ultima analisi, di comprendere se questa possa essere considerata legittima.
Over the last few years, part of the judiciary has established a new form of precautionary estoppel, causing effects on the main proceedings. The judgment provides an opportunity to analyze the divergences on the subject and to look for the reasons of this change. Furthermore, the purpose is to describe the features of this new estoppel, and, finally, to under-stand whether it is legitimate or not.
